PRIVACY NOTICE

NIMES CONTRACT SERVICES, SIMPLIFIED STOCK COMPANY WITH VARIABLE CAPITAL, hereinafter referred to as “PLAYA VIVA” or the “Responsible Party,” interchangeably, is a legal entity constituted under the legal provisions of Mexico, duly registered in the Federal Taxpayer Registry and, among the activities permitted by its corporate purpose, includes acquiring, transmitting, alienating, or encumbering by any title, including mortgages, as well as owning and exploiting all kinds of movable and immovable property, constituting, transmitting, modifying, or extinguishing real and personal rights concerning the same.

PLAYA VIVA, in compliance with Articles 3, Section I, 15, 16, and 17 of the Federal Law on Protection of Personal Data Held by Private Parties, hereinafter referred to as the “Law,” is responsible for the use and protection of the personal data of its users and the natural and legal persons with whom it has business relationships, suppliers, service providers, business partners, and any other natural or legal person who comes into contact with it, hereinafter referred to as the “Users.” The use and protection of data will be carried out following the principles of legality, consent, information, purpose, loyalty, proportionality, and responsibility, for which reason the following is informed:

PLAYA VIVA, through this act, undertakes not to disclose the personal data of the Users, unless it has the authorization of the same Users or is established in this Privacy Notice or if the respective authorities request such data. Additionally, it will be authorized to disclose the personal information of the Users in case of a legal requirement by a competent authority, following the provisions of the Federal Law for the Prevention and Identification of Transactions with Illicit Resources (LFPIORPI).

The personal data referred to in this Privacy Notice may be collected by PLAYA VIVA, by its collaborators, employees, or allies, when provided directly by the Users at the PLAYA VIVA offices, through instant messaging, phone calls, the website www.lopezrosa.com, email, social networks, and through the following platforms and web servers: Open Ai, Google, Drive, Sheets, Encharge, Ionos (the “Responsible Party” web server), email, Stripe (payment platform), Crisp (omnichannel tool), Docusing, Covermanager when necessary for the provision of its services.

Thus, and in compliance with the Law, PLAYA VIVA informs:

Personal data subject to processing

The personal data of the Users to be processed for the use of PLAYA VIVA are: full name or corporate name, occupation, marital status, gender, date and place of birth, address, mobile and landline phone numbers, email address, valid official identification issued by the National Electoral Institute, valid passport issued by the Ministry of Foreign Affairs, professional license, tax status certificate, documents accrediting the legal representative’s personality and/or the existence of the legal entity, proof of address, Unique Population Registry Code, among others. When it comes to financial information such as account statements and/or bank account numbers, if applicable, PLAYA VIVA will explain with complete certainty and clarity to the Users the reason for requesting such personal data and the scope of the same.

PLAYA VIVA will under no circumstances request information considered sensitive; however, if it does, it will fully explain to the User the reason for the request and the treatment that will be given to the same.

Purpose of processing personal data

The personal data will be processed in accordance with the following main purposes: for the preparation of contracts and legal documents related to real estate, customer information tracking, and invoicing. Additionally, the personal data will be processed in accordance with the following secondary purposes: to send promotions and advertising, as well as to send information to users about additional projects offered by PLAYA VIVA.

Users may request that PLAYA VIVA, by sending an email to info@playaviva.mx, not use their personal data for other purposes. PLAYA VIVA must respond to such a request no later than five business days after receiving the request, in which case the use of their personal data will be limited to the main purpose.

Options and means the Responsible Party offers to limit the use or disclosure of personal data

The security of Users’ information is a priority for PLAYA VIVA, which is why PLAYA VIVA will safeguard the personal data of the Users on cell phones with passwords and through a server that contains a data cloud, with limited access as it can only be accessed through invitation on the computers used by PLAYA VIVA collaborators, and access must be approved. Additionally, physical information will be backed up in filing cabinets with security keys to limit access to authorized persons. Consequently, PLAYA VIVA has implemented internal policies and processes applicable to its staff, whereby personal data is used by a minimum number of people, limiting the use of reproduction media. Authorized personnel for handling personal data will be PLAYA VIVA’s management, sales operations, marketing operations, and administrative staff, as well as allies executing commercial projects within the company. As a sign of goodwill, PLAYA VIVA has signed confidentiality agreements with its workers and collaborators.

PLAYA VIVA will not be responsible for the illegal interception of communications by third parties. If PLAYA VIVA becomes aware of such a circumstance, Users will be notified by any means to take appropriate measures to safeguard their data.

PLAYA VIVA certifies that it may transfer users’ or clients’ personal data, which will be national, to strategic allies who require it. The purpose of data transfer is commercial.

Means to exercise rights of Access, Rectification, Cancellation, or Opposition (ARCO)

Users may exercise their rights of access, rectification, cancellation, or opposition at any time by submitting a request in terms of Chapter IV of the Federal Law on Protection of Personal Data Held by Private Parties by writing to the Responsible Party addressed to the Personal Data Protection Department or, as the case may be, to the person in charge, sent to the email address info@playaviva.mx. The request must be attended to within a maximum period of five business days from the date of receipt of the request, with acknowledgment of receipt, issuing the corresponding determination for the legal effects that may arise. Notifications made by any other means will not be valid.

The revocation of consent may be made under the same terms as the previous paragraph, through the respective cancellation request.

Changes to the Privacy Notice

In the event that PLAYA VIVA needs to modify the content of this Privacy Notice, it reserves the right to change, modify, supplement, and/or alter this Privacy Notice at any time, in which case it will notify Users no later than 15 business days after the changes have been made, through the website www.lopezrosa.com, making the new Privacy Notice available to them, applying the provisions of the Law for the expression of Users’ will. All modifications to this Notice will take effect 30 calendar days after their publication in any of the pages of the website www.lopezrosa.com or any other means used for such purposes.

Consent for the Processing of Personal Data

Users, by providing any type of personal data to PLAYA VIVA, tacitly consent to the processing of the same in accordance with the purposes established in this Privacy Notice. This consent may be revoked at any time by the User through the procedures previously established for the exercise of their ARCO rights.

The User’s refusal for the use of their personal data for secondary purposes will not be a reason for PLAYA VIVA to cease providing the services and products requested by the User.

Policies and Terms of Responsibility

Medical Expenses: Medical and hospital expenses due to illness during the stay are the responsibility of the traveler.

Accidents: PLAYAVIVA is not responsible for accidents or mishaps within the facilities.

Personal Items: PLAYAVIVA is not responsible for the loss of personal and/or material items within the facilities.

Natural Disasters: PLAYAVIVA is not responsible for expenses, evacuations, or inconveniences caused by tropical storms, hurricanes, or any event beyond our control, including acts of nature.

Illicit Substances: They are strictly prohibited on the premises. Necessary measures will be taken with local authorities.

Reservation Policies

Availability: Reservations are subject to availability.

Rates and Promotions: All rates, promotions, and discounts are subject to change without prior notice.

External Food and Drinks: Bringing external food and drinks to the beach club or restaurant is not allowed.

Children's Age: Children are considered up to 17 years old. From 18 years old, they will be charged as adults.

Supervision of Children: Children must be supervised at all times within the facilities, including bathrooms, showers, and activities.

  • Shirt or T-shirt with sleeves. 
  • Pants or shorts. 
  • Sandals or shoes.

Women: 

  • Blouse or shirt. 
  • Shorts, pants or dress.

Regulations for Aquatic Activities

Use of Safety Equipment:

All participants must use appropriate safety equipment according to the type of aquatic activity. This includes life jackets, helmets, and any other gear provided by the administration.

Underaged:

Any minor must be accompanied by a parent or guardian who will be responsible for the supervision and care of the minor during any aquatic activity.

Prohibition of Alcohol:

  • The consumption of alcohol before and during aquatic activities is strictly prohibited. These substances can negatively affect coordination, judgment, and reaction times, endangering personal safety and the safety of other participants.

Weather Conditions and Water State:

  • Aquatic activities should only be conducted under suitable and safe weather and water conditions.

Conduct Rules:

  • All participants are expected to maintain safe and respectful behavior at all times. This includes avoiding reckless or careless behavior that could endanger their own safety or that of others.

Responsibility Waiver:

  • All users must sign the responsibility waiver on the day, time, and use of aquatic activities.


Note: We have properly trained personnel for first aid and supervision of aquatic activities.

If you bring your own aquatic equipment, Playaviva is not responsible for its use, damage, supervision, or other issues.


Beach Club Rules

1. Admission

1.1 Mandatory Registration:

  • Investors: Present an official photo ID and QR code from the portal.
  • General Public: Pay the fee and present an official photo ID.

1.2. Membership fees must be paid on time. Failure to do so may result in suspension or cancellation of membership.

1.3. Members may bring guests, who must register at the entrance and pay a visitor fee.

1.4. Thermoses, cups, or containers of beverages or food may only be brought in if empty.

2. Operating Hours

2.1. The club is open from 10:00 a.m. to 6:00 p.m. every day.

2.2. Access to certain areas may be restricted outside of established hours.

3. Use of Facilities

3.1. Smoking is prohibited in all areas.

3.2. Pets are not allowed.

3.3. The entry of external food and drinks into our restaurant or beach club service is prohibited.

3.4. The entry, consumption of illicit substances is prohibited.

4. Safety

4.1. All beach safety rules must be followed, including the instructions of lifeguard personnel.

4.2. The use of life jackets is mandatory for water activities.

4.3. The use of fireworks within the club premises is prohibited.

4.4. We have exclusive parking spaces for customers, where they are solely responsible for any damage or loss to their vehicles or contents.

5. Conduct

5.1. All members are expected to maintain respectful and considerate behavior towards others.

5.2. Violent, abusive, or disruptive behavior will not be tolerated. Violation of this rule may result in immediate expulsion from the premises.

5.3. Parents are responsible for the conduct of their children at all times.

6. Activities and Events

6.1. Events organized by the club will be subject to specific regulations established for each occasion.

6.2. Members may reserve areas for private events, subject to availability.

6.3. The sale of products and services within the club is prohibited without prior authorization from management.

7. Sanctions

7.1. Violation of club rules may result in warnings, fines, suspension, or revocation of access.

8. Modifications to the Regulations

8.1. The governing committee reserves the right to modify these regulations. Changes will be communicated to members in advance.

9. Final Provisions

9.1. Any situation not provided for in these regulations will be resolved by management, whose decision will be final and unappealable.

9.2. These regulations come into effect from the date of publication and are mandatory for all members and visitors to the club.

It is important to note that, once access to the facilities is paid, customers are accepting these regulations, so PLAYAVIVA TELCHAC may request the departure of anyone who fails to comply with these stipulations.
